A letter that I
am sending to all of the 2008 Presidential Candidates: A
Petition to strengthen laws that would hold public officials who
have purposely misused their positions in government.
Hello,
We, "The American People", are
sending this letter to all of our valued legislators.
As you all know, the current
situation in our government, allows for the dismal lack of
personal accountability of government officials. This lack of
accountability allows for abuses. These abuses can adversely
affect the functioning of services to the American people that
they have sworn and are required by law to uphold. I have
learned from personal experience, observations and from the
numerous stories shared from federal employees of various
federal agencies that this is a problem that in our opinion is
epidemic. These observations go beyond the anecdotal....one only
has to track the number of complaints explained in the Federal
Times or a variety of Federal worker's Unions publications.
Even the Internet has
volumes of sources demonstrating that this is the case. Any
person that googles for lawsuits filed against a government
agency by their employees will see that the numbers filed are
legion.
The sad fact is, most
federal employees are too fearful to report to their congressman
or any representative that the agency they are working for are
making a practice of breaking laws that often do disservice to
the American people and sometime even puts them unnecessarily in
harms way.
The fear that these federal
employees feel may seem silly by people who do not work in the
federal sector, but from both personal experience and from other
sources, the truth is, sometimes legislators will not respond or
they will simply tell you that the particular union that a
federal employee may be represented by, is responsible for
filing a grievance, until resolution is agreed upon by the
federal agency and the union.
It is my experience that
this system is broken...if indeed it ever worked. I have
personally heard from managers and administrators in the federal
sector actually, laugh and brag about their ability to do what
they wanted, because they knew that the government, --- The
Justice Department in particular would protect them.
I have found this to be
true.
We understand that
legislators may cringe at the thought of anyone in working for
the government being held personally accountable for any
unfortunate situation that arises, such as for example: A
private citizen slipping and falling from a water spill in a
congressman’s office trying to collect damages from the
congressman. In this case, obviously, he must be protected by
the government.
In a second scenario: A
person may work for FEMA or any government agency and if an
administrator, manager or supervisor for that agency breaks laws
and harms another person at that agency working above, alongside
of, or under their command or a private citizen, then they
should be help personally accountable.
In a third scenario: A
person may work for any government agency and if an
administrator, manager or supervisor or anyone working for that
agency breaks laws which undermines the service they have sworn
to uphold to the American public; need to held personally
responsible. Especially if it can be demonstrated that the
people accused have done so with purposeful intent. In addition,
if it can be shown that they were directed by their superiors to
break such laws, then they must also be held accountable.
They must be held
accountable by the Justice Department and not reflexively
protected. In addition, in some cases, if enough people show
interest through their submission of signatures on petitions, or
a certain volume of e-mails and letters sent to their
legislators, then the American public should have a right to
require that congressional and senate investigations are
enforced and that these investigations or hearings should be
open and transparent to the American People.
We are petitioning each
Presidential candidate and all legislators to create or
strengthened laws that would insure that public officials are
held legally accountable for laws that are broken during
intentional misuse of their positions in government.
It is our view that in
situations that arise when government employees blows the
whistle on the agency they work for, or file complaints against
the supervisors, managers, or administrators of that federal
agency; it should be required by law that their federal
legislators and the Justice Department work together
aggressively in to this matter.
It should be required by law
that both the legislators and the Justice Department investigate
these accusations fully, with the attitude of an unbiased legal
and investigative umpire.
It is our view that the
Justice Department should be required by law to participate in
such a way, instead of ignoring complaints and waiting in the
unlikely event that federal employees sue for resolution.
